General terms and conditions
These general terms and conditions apply to all offers and agreements of De Buitenjan Exploitatie B.V. concerning the sale and purchase of e-tickets for access to Klimrijk Brabant and the activities offered on or from the park (both De Buitenjan Exploitatie B.V. and Klimrijk Brabant will hereafter be referred to together): ‘Klimrijk De Buitenjan’ or the ‘Park’). De Buitenjan Exploitatie B.V. has its registered office at Turfweg 9, in Veldhoven (5504 RL) and is registered with the Chamber of Commerce under number 17128695. Klimrijk De Buitenjan reserves the right to amend these general terms and conditions. By placing an order via the webshop, you accept the offer of Klimrijk De Buitenjan.
By fully and correctly completing the booking procedure on the website of Klimrijk De Buitenjan, the agreement to book an activity between you and Klimrijk De Buitenjan is established. As soon as Klimrijk De Buitenjan has received the total amount due for the activity booked by you, it will send you a confirmation of your booking to the e-mail address you provided. Klimrijk De Buitenjan uses the payment environment of Ingenico Financial Solutions SA-NV (hereinafter referred to as: Ingenico). When paying for the order you have the choice between VISA and MasterCard. Once your payment has been verified, we will be informed that the order has been paid. The purchase amount is immediately debited and charged.
You are personally responsible for correctly and fully completing your details when booking the desired activity. Providing incorrect or incomplete information may result in the requested booking confirmation not being sent. In such instances, Klimrijk De Buitenjan is not obliged to pay you any compensation.
Each booking confirmation has a unique booking number. This booking number is scanned at the entrance to the park. Each booking number may only be used once and has a validity period/date. Outside this period/date the booking number is not valid. When leaving Klimrijk De Buitenjan, but in any case by closing time of Klimrijk De Buitenjan on the day of visit, the validity of the booking number and unused parts of a possible arrangement will expire. The booking confirmation must be shown at the request of an employee of Klimrijk De Buitenjan. Reselling and/or falsifying a booking confirmation or using it for commercial purposes is not permitted.
A booking confirmation must be clearly printed on paper (colour or black and white) or be clearly legible on the screen of a mobile phone or tablet. If, in the opinion of Klimrijk De Buitenjan, the booking confirmation is not legible, it does not entitle you to access the activity you booked. In such instances, Klimrijk De Buitenjan is not obliged to pay you any compensation. Klimrijk De Buitenjan is authorised to change its climbing and opening hours. Children under the age of 13 may only enter the park under the constant supervision and guidance of an adult. Klimrijk De Buitenjan is authorised to close (a) part(s) of the climbing course, without being obliged to pay any compensation to its visitors.
The agreement to book an activity may not be rescinded by you. Booking confirmations are not taken back by Klimrijk De Buitenjan and cannot be exchanged for money or be replaced with another booking. The validity date and time mentioned on the booking confirmation will not be extended by Klimrijk De Buitenjan.
Klimrijk De Buitenjan is not liable for any damage you suffer in case your booking cannot be completed, processed and/or authorised in time, or at all, due to a technical malfunction of any kind. In such instances, Klimrijk De Buitenjan is not obliged to pay you any compensation.
On the agreement to book an activity, in addition to these general terms and conditions, the park regulations of Klimrijk De Buitenjan apply. By entering the park, you declare that you agree to these park regulations. Klimrijk De Buitenjan reserves the right to amend these park regulations.
Klimrijk De Buitenjan processes your personal data carefully and in doing so adheres to the laws and regulations for the protection of personal data. The information provided by you during the booking procedure will be processed by us for the execution of the agreement between you and Klimrijk De Buitenjan and to meet our legal obligations. Without this personal data, your booking can be delayed or become impossible, as a result of which your order may be cancelled. The information you provide will be kept on record for as long as necessary for the purpose as described above. The privacy statement of Klimrijk De Buitenjan applies to the processing of personal data. For the payment of your booking, Klimrijk De Buitenjan makes use of the services of Ingenico; Ingenico is the data controller in this matter. The processing of personal data by Ingenico is subject to the privacy statement of Ingenico.
